By accessing or using PropAI Canada(the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

PropAI Canadais an AI-powered real estate platform that connects prospective buyers, renters, and investors with property listings across Canada. The Service includes an AI voice agent ("Aria") that answers inbound calls, qualifies leads, books property viewings, and shares listing information.

All property listings and information provided through the Service are for informational purposes only and do not constitute offers to buy, sell, or lease any property. Availability and pricing are subject to change without notice.

3. AI Voice Agent & Communications

By submitting an inquiry through our contact form, calling our listed phone number, or otherwise initiating contact, you consent to interacting with an automated AI voice agent and to receiving a follow-up call or message from PropAI Canada or its AI systems regarding your inquiry.

Calls and interactions with the AI agent may be recorded and transcribed for quality assurance, record-keeping, and service improvement purposes. You will be notified at the start of any recorded session where required by law. By continuing to interact with the agent, you consent to such recording.

4. No Real Estate or Financial Advice

The information provided through the Service—including property descriptions, pricing estimates, neighbourhood details, and market commentary—is general in nature and is not a substitute for professional real estate, legal, financial, or tax advice. You should independently verify all information and consult licensed real estate agents, lawyers, or financial advisors before making any real estate transaction or investment decision.

5. User Responsibilities

You agree to:

• Provide accurate, current, and complete information when using the Service.
• Use the Service only for lawful purposes and in accordance with these Terms.
• Not impersonate any person or entity or misrepresent your identity or affiliation.
• Not use the Service to transmit unsolicited commercial communications or spam.
• Not attempt to access, probe, or disrupt systems or networks connected to the Service.

6. Property Listings

Property listings displayed on the Service are sourced from PropAI Canada's database and third-party providers. PropAI Canada does not guarantee the accuracy, completeness, or timeliness of listing information. Availability and pricing are subject to change without notice, and PropAI Canada makes no representations that any property is available for purchase or lease at any listed price.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of PropAI Canada and its licensors. Our trademarks, trade names, and service marks may not be used in connection with any product or service without the prior written consent of PropAI Canada.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Limitation of Liability

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, PropAI Canada shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service, even if PropAI Canada has been advised of the possibility of such damages.

9. Third-Party Services

The Service integrates with third-party platforms including, but not limited to, voice agent providers, appointment scheduling tools, messaging services, and database hosting providers. Your use of these integrations is subject to those third parties' own terms of service and privacy policies. PropAI Canada is not responsible for the practices or content of any third-party services.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
